Agreement to Terms

By accessing and using the services of Perfumecalmcraft, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use our appliance repair services or website.

Services Provided

Perfumecalmcraft provides professional appliance repair services for household appliances. We offer diagnosis, repair, maintenance, and consultation services for various appliance brands and models.

Attempting to reverse engineer, decompile, or disassemble any part of our website or services
Impersonating any person or entity or falsely representing your affiliation with any person or entity

Consequences of Violation

Violation of these acceptable use rules may result in immediate termination of services, legal action, and reporting to appropriate authorities. We reserve the right to refuse service to anyone who violates these terms.

Service Limitations

While we strive to provide quality repairs, we cannot guarantee that all appliances can be repaired. Some appliances may be beyond economical repair due to age, condition, or availability of parts. We will inform you of such situations before proceeding.

Pricing and Payment

All pricing is provided upfront before work begins. Payment is due upon completion of service unless other arrangements have been made. We accept various payment methods as discussed during service scheduling. Prices are subject to change, but you will be notified of any changes before work commences.

Warranty

We provide a warranty on parts and labor for repairs performed by Perfumecalmcraft. Warranty terms vary by service type and will be explained at the time of service. This warranty does not cover damage caused by misuse, normal wear and tear, or damage resulting from factors beyond our control.

Limitation of Liability

To the maximum extent permitted by law:

Perfumecalmcraft's liability is limited to the cost of the service provided
We are not responsible for indirect, incidental, consequential, special, or punitive damages arising from appliance repairs, service delays, or use of our website
We do not guarantee that our services will be uninterrupted, error-free, or completely secure
We are not liable for any issues arising from third-party services or products used in connection with our services
You are responsible for backing up important data and taking appropriate precautions before service is performed

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law. Your statutory rights as a consumer are not affected.

Dispute Resolution

If a dispute arises between you and Perfumecalmcraft, we encourage you to contact us first to attempt to resolve the matter amicably.

Informal Resolution

Before initiating formal dispute resolution procedures, you agree to contact us at the contact information provided below to discuss the dispute and attempt to reach a mutually acceptable resolution. We will make good faith efforts to resolve disputes within 30 days of receiving your complaint.

Mediation

If informal resolution is unsuccessful, disputes may be referred to mediation through an independent mediator agreed upon by both parties. Mediation costs will be shared equally unless otherwise agreed.

Arbitration

If mediation is unsuccessful or not pursued, disputes will be resolved through binding arbitration in accordance with the Arbitration Act 1996 (New Zealand) or any successor legislation. Arbitration will be conducted by a single arbitrator appointed in accordance with the rules of the New Zealand Disputes Tribunal or similar recognized arbitration body.

Court Proceedings

Notwithstanding the above, either party may seek injunctive relief or other equitable remedies from a court of competent jurisdiction at any time. Additionally, disputes involving amounts less than NZD $15,000 may be resolved through the New Zealand Disputes Tribunal.

Class Action Waiver

You agree that any disputes will be resolved on an individual basis and waive any right to participate in class actions, consolidated proceedings, or representative actions.

Applicable Law

These Terms of Use are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

Jurisdiction

Subject to the dispute resolution provisions above, you agree that any legal proceedings arising from or relating to these terms or our services will be brought exclusively in the courts of New Zealand, and you consent to the personal jurisdiction of such courts.

Compliance

You are responsible for ensuring that your use of our services complies with all applicable local, national, and international laws and regulations.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Material changes will be communicated through prominent notices on our website or via email. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement
